Property, Rating and Housing

Juan advises in relation to private and commercial property matters and landlord and tenant issues.  Juan regularly advises and acts for private landlords in housing matters, including possession actions, disrepair, forfeiture (including breach of covenant and non-payment), and related damages claims.

He has particular expertise in rating, easements, restrictive covenants, adverse possession and contested applications concerning land registration.

Juan advises and acts in respect of applications before the Adjudicator to HM Land Registry. 

He also appears in inquiries concerning the law of town and village greens.

Juan has also advised extensively on moorings, riparian rights and navigation.

 

Recent cases include:

Adjudication to HM Land Registry; land at Weybridge, Surrey [2011]: contested application for the cancellation of a unilateral notice; jurisdiction to enter a unilateral notice and the characterisation of qualifying beneficial interests.

Land at Bethnal Green Road [2011] Compulsory Purchase Order Inquiry; objecting to inclusion of residential order property on the basis of the satisfactory condition and occupation of the property and revival of it's use.

Land at The Wireworks, London SE1 [2011]: considering the first instance decision in Secerno Ltd, Sportsworld Ltd & Xou Solutions Ltd v Oxford Magistrates' Court & Another [2011] EWHC 1009 (Admin) and the character of the obligation formerly imposed on the billing authority under regulation 42 of the Non-domestic Rating (Alteration of Lists and Appeals) (England) Regulations 2005/659, for the purposes of a liability order application.

Alamin v Sevket [2011]; High Court: appeal against finding of a failure to comply with section 214 of the Housing Act 2004 and the initial requirements of the Deposit Protection Service in the case of residential occupation under an assured shorthold tenancy, considering jurisdictional competence of the Court, applying Draycott v Hannells Letting Ltd [2010] EWHC 217.

Grand Parade Limited v East Lindsey District Council [2010]: successfully opposing application for planning injunction prohibiting the temporary use of land for retail sales from a trailer.
