Judicial Review

Juan acts and advises extensively in the area of judicial review. 

His experience in this area extends far beyond planning, environmental and licensing law. His cases often incorporate a full consideration of EU law principles.

Juan also has particular experience of protective costs order applications and group litigation.

Juan's extensive experience of injunctions enables him to regularly advise on the most effective ways of preventing or curbing commercially prejudicial actions.

Recent cases include:

R (oao Coleman) v London Borough of Barnet [2011]: landmark judicial review quashing planning permission granted following the planning authority's failure to discharge their duty under section 149 Equality Act 2010 in light of development impacts upon disabled and elderly users.

Land at Tideway Wharf [2011]: judicial review of grant of planning permission for mixed use development comprising 752 residential units, a hotel, commercial uses and retail.

R (oao Aksu) v London Borough of Enfield [2011]: judicial review and related interim relief applications brought in respect of stop and temporary stop notices.

R (oao Dulai & Others) v Chelmsford Magistrates Court [2011]: judicial review arising in respect of the issue of a warrant of entry and search of business premises and the subsequent seizure of property for the purposes of enforcement investigations into suspected breaches of food law.

R (oao Dulai & Others) v Essex County Council, Trading Standards [2011]: exercise of Crown Court's administrative jurisdiction under s.59 Criminal Justice and Police Act 2011: acting on behalf of co-applicants establishing the ultra vires seizure of property.

R (oao Christian Institute) v Cornwall County Council [2011]: lawfulness of issue of sex shop licence.  

R (oao Save Britain's Heritage) v (1) Secretary of State for Communities and Local Government (2) Gateshead Metropolitan Borough Council [2010] EWCA Civ 1500 [No.2]: planning injunction; lawfulness of prior approval; meaning of "demolition" for the purposes of EIA development under EIA Directive and the Regulations; "salami-slicing" within the context of the Bridging Newcastle Gateshead, multi-phase demolition and regeneration scheme.
