Outdoor Advertising

The control of outdoor advertising is one of the most litigated areas of planning law, possibly because of the complexity of the statutory code which governs not just poster advertising but shop fronts, signs and all forms of displays. The statutory regime is based upon the Town and Country Planning Act 1990 and the Town and Country Planning (Control of Advertisement) Regulations 2007, supplemented by the Anti-social Behaviour Act 2003, the Clean Neighbourhoods and Environment Act 2005 and the various London Local Authorities Acts.

Members of Chambers appear regularly both for local authorities and for advertising contractors, and have been involved in many of the significant cases at inquiry/hearings and in court - including the recent cases of R (Blow Up Media) v Lambeth LBC (2008), relating to delegation of powers, section 11 notices and human rights, and Calderdale MBC v Calderdale Magistrates Court (2010), relating to enforcement powers against mobile advertisement hoardings in farmers' fields.
