Highways
Chambers is involved in all aspects of highways law at all levels, whether promoting or resisting major road proposals or challenging public path proceedings for breach of natural justice (e.g. R v Secretary of State ex parte Slot [1998] JPL 692, CA).
Other major landmarks in the field of highways law involving members of Chambers include R v Secretary of State ex parte de Rothschild [1989] 1 All ER 933, CA, which establishes the test to be applied in confirming compulsory purchase orders, Batchelor v Kent County Council (1990) 59 P&CR 357, CA, where ransom value was awarded as part of the compensation for compulsory purchase of land for access to development, and two cases concerning the Central London congestion Charging Scheme (R (Westminster City Council) v. Mayor of London [2003] LGR 611 and R (Walmsley) v Lane [2006] LGR 280).
Chambers also regularly deals with highways related development and orders, such as motorway service area applications, road traffic regulation orders and stopping up orders, often as part of urban regeneration projects.
Recent highway schemes in which members of Chambers have been involved include the Thames Gateway Bridge and the Twin Sails Bridge at Poole.
