Compulsory Purchase & Land Valuation
There are two main areas covered by land valuation that Members of Chambers become involved with - Compulsory Purchase & Compensation and Rating.
Compulsory Purchase & Compensation
Members of Chambers have considerable experience in advising in relation to compulsory purchase generally and, in particular, appearing at public local inquiries for both acquiring authorities and objectors. Recent examples include the inquiries into Thameslink 2000, Wembley Stadium Link, the regeneration of Greenwich Peninsula, the Olympic 2012 proposals and Extensions to the Midland Metro system in Birmingham.
FTB members have considerable experience in advising and appearing in the Lands Tribunal in relation to such compensation claims, and in relation to subsequent appeals to the Court of Appeal. Recent examples include Purfleet Farms Ltd v Secretary of State for Transport; Colneway Ltd v Environment Agency; Christos v Secretary of State for Transport; Optical Express v Birmingham City Council; RMC and ACE v London Borough of Greenwich; Moto v. Secretary of State for Transport.
Amongst the members of Chambers are the editors of one of the leading textbooks on compulsory purchase and compensation: Tottel's Compulsory Purchase and Compensation Service (2 volume looseleaf publication).
Rating
Members of Chambers have considerable experience in advising in relation to the full range of rating matters and in appearing in Tribunals and courts on rating matters. Indeed, members have advised and appeared in almost all of the major rating cases in recent years (both in England and Wales and abroad). These include BT v. Sanderson; Best Origin v. Commissioner for Rating & Valuation; Imperial College v. Ebdon, Monsanto v. Farris and Eastbourne B.C. and Wealden D.C. v. Allen; H.J. Banks v. Speight; Harrods v. Baker; Orange PCS v. Bradford; Coventry & Solihull Waste Disposal v. Russell.
Two of the three editors of the standard textbook, Ryde on Rating & the Council Tax, are members of Chambers.
