TILIANU V. SECRETARY OF STATE FOR WORK AND PENSIONS [2010] EWCA Civ 1397 

Denis Edwards acted as junior counsel for the Secretary of State for Work and Pensions in resisting the Claimant's appeal.  The Court of Appeal decided that an unemployed EU citizen who was previously a self-employed person in the UK does not retain that status or the status of a worker under Article 7(3) of Directive 2004/38/EC so as to be entitled to claim social security benefits in the UK.  This is one of the first cases decided by the UK courts on the meaning of Article 7 of the Residence Directive.
