COURT OF ARCHES PERMIT 3G PHONE MAST IN CHURCH TOWER

The Court of Arches has allowed an appeal against a judgment of Chancellor George Pulman QC
(sitting in the Consistory Court of the Diocese of Chelmsford) whereby he refused to grant a faculty
for a 3G phone mast in a church tower on the basis that it would facilitate the transmission of pornography.

The Court held that carrying out a balancing exercise - which involved taking into account the benefits of
the proposal and the safeguards put in place by the mobile phone operators - it was appropriate to
grant the faculty.

Charles George QC and Philip Petchey (instructed by Lee Bolton and Lee) appeared for the Appellant,
QS4 Limited and the Rector and Churchwardens of St Peter and St Paul, Chingford.
